Terms of Service

§ 1 Agreement to Terms

By accessing or using Carofix.com ("Platform," "we," "us"), you agree to be legally bound by these Terms of Service. These Terms constitute a binding agreement between you and Carofix. If you do not agree to these Terms, you must not access or use the Platform.

§ 2 Carofix is a Marketplace Platform Only

• We do not provide automotive services, sell parts, perform repairs, or offer towing.
• We are not a party to any transaction between you and a Vendor.
• We do not employ, supervise, or control Vendors. Vendors are independent contractors.
• All service agreements are solely between you and the Vendor you select.

§ 3 Service Pro Subscription

Most of the Platform's core features are available free of charge. Access to advanced features is available through the Service Pro subscription tier, which includes unlimited auto-send requests, priority vendor matching, and other enhanced tools for car owners and vendors, for a subscription fee of $20 per year.

• Subscription fees are non-refundable except where required by applicable law.
• We reserve the right to change subscription pricing or features with 30 days' written notice to active subscribers.
• Access may be suspended or terminated for non-payment.

§ 4 No Warranties or Guarantees

The Platform is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the quality, safety, legality, or reliability of Vendors or their services. You acknowledge that:

• We do not verify Vendor licenses, insurance, or certifications unless explicitly stated.
• We are not responsible for Vendor conduct, pricing, delays, damages, or workmanship.
• Your use of any Vendor is entirely at your own risk.

§ 5 Limitation of Liability

To the maximum extent permitted by applicable federal and state law, Carofix, its officers, directors, employees, agents, licensors, and service providers shall not be liable for any damages of any kind arising from or in connection with your use of the Platform, including but not limited to:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages;
• Loss of profits, revenue, data, goodwill, or other intangible losses;
• Property damage or personal injury arising from Vendor services;
• Unauthorized access to or alteration of your data or transmissions;
• Any conduct or content of any third party on or through the Platform;
• Any disputes between you and a Vendor.

These limitations apply regardless of the legal theory under which liability is asserted (tort, contract, strict liability, or otherwise), and even if Carofix has been advised of the possibility of such damages.

In any event, Carofix's total aggregate liability to you for all claims shall not exceed the greater of (a) the total amount you have paid to Carofix in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be excluded or limited under applicable law.

§ 6 User Responsibilities

By using the Platform, you agree to:

• Provide accurate, current, and complete information at all times;
• Pay Vendors directly as agreed upon in your service arrangement;
• Resolve billing and service disputes directly with Vendors;
• Comply with all applicable local, state, and federal laws;
• Not use the Platform for any unlawful, harmful, or fraudulent purpose.

§ 7 Payments

Carofix does not process or facilitate payments between car owners and Vendors. All payments are made directly between you and your chosen Vendor. We are not responsible for refunds, chargebacks, or payment disputes between you and any Vendor.

Subscription fees for Service Pro are processed separately and are subject to the terms stated in Section 3.

§ 8 Communications Disclaimer — CDA § 230

Carofix is an interactive computer service as defined under the Communications Decency Act. Pursuant to 47 U.S.C. § 230, we are not liable for content posted, transmitted, or published by users or Vendors on the Platform, including but not limited to reviews, service quotes, messages, or other user-generated content.

§ 9 Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the federal laws of the United States of America and the laws of the State of New Jersey, without regard to conflict of law principles.

Any legal action, claim, or proceeding arising out of or relating to these Terms or the Platform shall be brought exclusively in the federal or state courts of competent jurisdiction located within the State of New Jersey. You and Carofix irrevocably consent to the personal jurisdiction and venue of such courts.

§ 10 Changes to Terms

We reserve the right to modify or update these Terms at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this document and, where appropriate, provide additional notice (such as an email notification to active subscribers). Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
